Terms of Service

Welcome to South West Coast Path Guide. By downloading or using the App you agree to be bound by these Terms of Service. Please read them carefully.

1. Acceptance of terms

By creating an account, accessing or using South West Coast Path Guide ("the App", "the Service"), you agree to these Terms of Service with Ponferrada Pty Ltd, 92 Buckland Street, Alexandria, NSW 2015, Australia ("we", "us").

We may update these terms from time to time. Continued use of the Service after changes constitutes acceptance of the updated terms. We will notify registered users of significant changes by email.

2. Account registration & responsibilities

To access certain features you may need to create an account. When you register you agree to:

• Provide accurate and complete information (name and email address)
• Keep your login credentials secure and confidential
• Notify us immediately of any unauthorised use of your account
• Accept responsibility for all activity that occurs under your account

You must be at least 16 years of age to create an account. We reserve the right to suspend or terminate accounts that violate these terms.

3. Acceptable use

You agree to use the Service only for lawful purposes and in accordance with these terms. You may not:

• Use the Service for any illegal or unauthorised purpose
• Attempt to gain unauthorised access to any part of the Service
• Interfere with or disrupt the Service or its infrastructure
• Scrape, crawl or use automated tools to extract data without permission
• Upload or transmit malicious code, viruses or harmful content
• Impersonate another person or misrepresent your identity
• Use the Service to send unsolicited communications or spam

4. Intellectual property

All content in the App - including text, graphics, logos, maps, images, stage guides and software - is the property of South West Coast Path Guide or its licensors and is protected by copyright and intellectual property laws.

You may use our content for personal, non-commercial purposes. You may not reproduce, distribute, modify or create derivative works from it without prior written permission.

Map data is provided by Mapbox and OpenStreetMap contributors and is subject to their own terms. Trail data is compiled from publicly available sources and our own research.

5. Third-party links & affiliate disclosure

The App contains links to third-party websites and services, including accommodation booking platforms such as Booking.com and Expedia. Some of these are affiliate links - if you make a booking through them we may earn a commission at no extra cost to you.

We are not responsible for the content, accuracy or practices of third-party websites. Your use of third-party services is governed by their own terms and privacy policies.

6. Trail information & limitation of liability

Important: the information in the App - including stage guides, distances, elevation profiles, trail conditions, tide information and accommodation details - is for general guidance and planning purposes only. It does not constitute professional safety advice.

Coastal conditions change due to weather, tides, erosion, diversions and natural events. Distances and timings are approximate. You are responsible for your own safety when walking, and should:

• Check current trail conditions, diversions and tide times before and during your walk
• Carry appropriate gear, food and water for the conditions
• Consult the South West Coast Path Association, local authorities or the Coastguard for up-to-date safety information
• Make your own judgement about whether conditions are safe for walking

Nothing in these terms limits our liability for death or personal injury caused by our negligence, for fraud, or for any other liability that cannot be limited by law. Subject to that, to the fullest extent permitted by law we shall not be liable for any direct, indirect, incidental or consequential loss arising from your use of the Service or reliance on the information provided, including personal injury, property damage or financial loss.

7. User-generated content

If you submit content to the App (such as reviews, walk logs or photos), you grant us a non-exclusive, royalty-free licence to use, display and distribute that content in connection with the Service. You retain ownership of your content.

You are responsible for ensuring that anything you submit does not infringe the rights of others and does not contain offensive, defamatory or illegal material. We reserve the right to remove content that violates these terms.

We have zero tolerance for objectionable content or abusive behaviour. Photos and reviews are checked before they become publicly visible. You can report any content or user from within the App, and block content from another user if you find it harmful. Reported content is reviewed promptly, and content or accounts that violate these terms will be removed.

8. Termination

You may delete your account at any time in the App under Profile → Delete account, or by contacting us at hello@southwestcoastpathguide.com. See how to delete your account for step-by-step instructions.

Upon termination your right to use the Service ceases immediately. We will delete your personal data in accordance with our Privacy Policy. Content you contributed - reviews, walk logs and photos - is retained so it remains useful to other walkers, but is unlinked from your account and no longer shown with your name or profile. You can ask us to delete that content as well, at any time, by email.

9. Changes to these terms

We may revise these Terms of Service at any time. Changes are posted on this page with an updated "Last updated" date. For significant changes we will notify registered users by email. Your continued use of the Service after changes are posted constitutes acceptance of the revised terms.

10. Governing law

These terms are governed by the laws of New South Wales, Australia, and the courts of New South Wales, Australia have exclusive jurisdiction. If you are a consumer, this does not deprive you of the protection of mandatory consumer protection rules of your country of residence, including those of the United Kingdom or the EEA. Nothing in these terms excludes, restricts or modifies any consumer guarantee or right under the Australian Consumer Law that cannot lawfully be excluded.

11. App stores

The App is distributed via the Apple App Store and Google Play. Apple and Google are not parties to these terms, have no obligation to provide maintenance or support for the App, and are not responsible for the App or its content. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.
